Overview
These Terms of Sale apply to purchases from Von Reinhaart Atelier (“we”, “us”). By placing an order, you agree to these terms and our Privacy Policy.
Eligibility
- You must be at least 18 years old to purchase.
- You confirm you are purchasing as a consumer unless otherwise agreed in writing.
Orders & Acceptance
- Your order is an offer to buy the items listed in your cart. We may accept or reject any order at our discretion (e.g., stock unavailability, pricing error, failed payment checks).
- Order confirmation emails acknowledge receipt; acceptance occurs when we dispatch and issue a tax invoice.
Pricing & Currency
- Prices are shown in AUD unless stated otherwise and include/exclude GST as indicated on the product page and checkout.
- We may update prices at any time prior to acceptance. Promotional pricing may be time-limited.
Payment & Security
- Accepted methods: major credit/debit cards and other options shown at checkout.
- Payments are processed by secure third-party gateways. We do not store full card details.
- By paying, you authorise us to charge the total amount including taxes, shipping, and duties where applicable.
Shipping & Delivery
- We ship to the destinations listed at checkout. Estimated delivery dates are indicative and not guaranteed.
- You will receive tracking when available. Any delivery requires a signature and will require proof of identity for higher value works.
Risk & Title
- Risk in the goods passes on delivery to the address you provide (or upon collection). Title passes only after we receive cleared payment in full.
Requirement:Inspect packaging immediately on delivery and note any visible damage with the courier before signing and take clear video evidences.
Originals vs Non-OG
- Original Artworks (OG): Unique pieces produced as one-of-one works with limited availability.
- Non-OG items: Prints, textiles, and accessories may be produced in limited runs or editions.
- Transit damage or mis-shipments require reporting within 24 hours of delivery with clear videos.
Custom & Commissions
Custom or commissioned works are produced to your specification ( dimensions and medium ), while the artist reservers the right to execute the artwork(s) in a manner that best reflects her authentic artistic values and distinctive style. Such commissions are final once the artist commences work, except in circumstances where the work is faulty under the Australian Consumer Law.
Pre-Orders
- For pre-ordered items, estimated dispatch windows are provided on product pages or emails; these may change.
- We will notify you of material delays and offer options where required.
Taxes & Duties
- Australian orders: GST handled at checkout.
- International orders (if offered): You are responsible for local taxes, duties, and import fees unless we explicitly state Delivered Duties Paid (DDP).
Product Info & Colours
- We aim for accurate descriptions and imagery. Colour/texture may vary slightly due to lighting, materials, and screen calibration.
- Dimensions are approximate.
Availability & Errors
- We may correct errors, update information, or withdraw products without prior notice where permitted by law.
- If a pricing or stock error affects your order post-purchase, we will contact you with options (proceed, substitute, or cancel the order).
Cancellations & Changes
- Requests to change/cancel orders must be submitted immediately. We cannot amend orders that have entered fulfilment.
- Custom/commissioned works cannot be cancelled after artist commencement.
Fraud & Chargebacks
- We may conduct checks to prevent fraud and misuse. Suspicious orders may be declined or require additional verification.
- Unauthorised chargebacks may be pursued and information shared with payment providers per applicable laws.
Warranties & ACL
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or other remedy for a major failure and compensation for other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
These Terms operate alongside, and do not exclude, restrict, or modify, your rights under the ACL.
Liability
- To the extent permitted by law, our liability for non-ACL claims is limited to the amount you paid for the affected goods or the cost of re-supply, at our election.
- Nothing in these Terms limits liability where such limitation is not permitted by law.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of its courts.
